Terms of Service for Dance by Emmaleigh

These Terms of Service (“Terms”) govern the use and purchase of services provided by Spot Social Fitness, Inc. (“Spot,” “we,” “us,” or “our”), including the “Dance by Emmaleigh” classes offered in partnership with Studio D3 Orlando, Inc. (“D3”), located at the address above. By purchasing and/or participating in the dance classes, you (“you,” “client,” “participant”) agree to be bound by these Terms.

1. Overview of Services

Spot Social Fitness, Inc. (“Spot”) manages and sells 8-week multi-style dance class programs through our “Dance by Emmaleigh” offering. The program consists of weekly classes over an 8-week period (Wednesdays starting January 15, 2025). We offer separate sessions for teens (ages 12-17) and adults (ages 18+).

When you enroll, you will be primarily interacting with Spot for registration, payment, and updates. Once classes begin, your main contact will be the instructor. However, Spot remains available for support as needed.

Our partnership structure is as follows:

Spot Social Fitness, Inc.: Management entity responsible for class enrollment, payment processing, and overall coordination.
Studio D3 Orlando, Inc.: The physical location where classes are held.
Emmaleigh (Instructor): The instructor leading the classes on behalf of Spot.

2. Eligibility and Age Restrictions

By registering, you confirm that you meet the appropriate age criteria.

Teen Classes: Participants must be between 12-17 years of age.
Adult Classes: Participants must be at least 18 years of age.

3. Pricing and Payment

All payments are one-time charges. No recurring billing is currently in place.

Pricing:
- Standard Rate: $399 if purchased by January 15, 2025.
- Early Bird Rate: $299 if purchased by December 29, 2024.
- Exclusive BOGO Offer (for current customers): $239.40 (40% off the second enrollment when purchased together).
Payment Methods: We accept all major credit cards, as well as Affirm, Afterpay, and Klarna.

4. Refunds, Cancellations, and Rescheduling

Spot reserves the right to reschedule or cancel classes due to unforeseen circumstances (e.g., instructor illness, venue issues). In such cases, we will make reasonable efforts to offer a suitable alternative or make appropriate accommodations.

Refunds Before Program Start: If you must cancel before the program begins for a valid reason (e.g., health, relocation), you may request a 50% refund. Requests must be made before January 15, 2025.
No Refunds After Program Start: Once the 8-week program commences, no refunds will be granted.

5. Health and Safety Disclaimer

Dance and fitness activities inherently carry some risk of injury, though serious incidents are rare. By purchasing and participating in the classes, you acknowledge and assume all risks associated with the activity. Neither Spot, D3, nor Emmaleigh will be held liable for any injuries, accidents, or, in extremely unlikely circumstances, death resulting from participation. We strongly recommend consulting a physician before starting any new fitness program.

6. Photography, Video, and Media Release

Classes may be photographed or recorded for promotional and marketing purposes. Prior to any filming or photography, we will provide a release form. By signing the release, you grant permission for Spot, D3, and affiliates to use your image, likeness, and recorded performance for marketing, advertising, or any related business purpose.

7. Liability Waiver and Emergency Contact Information

All participants will be required to sign a liability waiver and provide emergency contact information prior to attending their first class. The waiver confirms that you understand the inherent risks and agree to hold Spot, D3, and the instructor harmless from any liability beyond what is permitted by law.

8. Intellectual Property

We do not provide digital materials for distribution. All branding, class structures, and associated content belong to Spot and may not be replicated, recorded, or distributed without prior written consent.

9. Governing Law and Dispute Resolution

These Terms and any disputes arising from them are governed by the laws of the State of Florida, specifically Orange County. In the event of a dispute, the parties will first attempt mediation. If mediation fails, the matter will proceed to binding arbitration, the decision of which shall be final and enforceable.

11. Modifications to Terms

We reserve the right to update these Terms at any time. You will be notified via email of any material changes, and continued participation in the classes after such updates constitutes acceptance of the new Terms.
